Canada Labour Code
defines the rights and responsibilities of workers and employers in federally regulated workplaces, and. sets out federal labour law.
Canadian Human Rights Act
provides protection against discrimination on many of the same grounds as the Ontario Code.
PIPEDA
The Personal Information Protection and Electronic Documents Act (PIPEDA) is the federal privacy law for private-sector organizations. It sets out the ground rules for how businesses must handle personal information in the course of their commercial activity.
Types of Discrimination
Intentional (direct)
Systematic (unintentional) AKA. Adverse impact discrimination
Bona fide occupational requirement (BFOR)
job qualifications that may be discriminatory due to business and safety reasons.
Reasonable Accommodation
Making adjustments to any aspect of working
conditions to prevent discrimination
- Employers expected to accommodate to the
point of “undue hardship” - Differences in undue hardship for small and
large organizations
Harassment
Any conduct or comment that any reasonable person would consider objectionable or unwelcome
Designated Group
Women, members of visible
minorities, Indigenous peoples, and
persons with disabilities who have
been disadvantaged in employment
