What would you consider before visiting site?
- I would consult the RICS surveying safely guide or the HSE website.
- Skanska have a minimum safety standards document which is user-friendly and clear on the steps we must take to ensure safety.
What are the RICS doing considering the Grenfell disaster?
- RICS are providing training
- Sharing opinions and advice on new bills and recent changes to fire legislation
- Have trained experts surveying the cladding on buildings.
What are the changes with cladding after Grenfell?
- Identifying all buildings that have unsafe cladding
* Building owners are now removing all cladding, or will be enforced too by the Gov.
What is RIDDOR?
• Reporting of injuries, diseases and dangers occurrence regulations 1995.
What are your views on the construction Playbook?
- Essential for Industry confidence in the UK Government led projects.
- Will hopefully cause more technologies to be adopted and used to make the industry more efficient and sustainable.
What are some solutions to mitigate the risk of material price increases?
- Ensure fluctuations are agreed in the contract.
- If the Contractor is to retain the risk of material price increases, they may demand high lump sum fees for this. However, the risk is that the Subcontractors do not agree to this and the contractor bares the risk.
- There is an increase in materials off site and advance payment bonds being used. (read in the modus journal).
- Use provisional sums
- More letters of intent are being used and pcsa’s.
What is Passive and Active fire protection?
- Passive is used to stop the fire spreading further
* Active is used to stop and put out the fire.
What are the current market trends that you are aware off?
- RICS New Article re. Fluctuating price contracts becoming more desirable… Resource costs have increased significantly.
- RICS BCIS Schedule of rates have been published for2022
How would someone fall inside IR35?
If HMRC finds that a contractor is being treated as a full-time employee, or is receiving the same benefits as a full-time employee, they will be deemed as inside IR35.

How did Project Norwood deal with Covid?
• Unable to claim loss and expense for COVID. However, we are able to claim an EOT in the event of any future restrictions put in place.
What does EWS stand for and why is it important with fire safety?
- External wall system must be designed and approved by an expert.
- We appoint IFC as out independent firm to review any impacts design has with fire.
How have you managed Brexit?
• We have a Brexit mitigation tracker that high risk trades completed
What is the Latham Report?
- Wrote a report named ‘constructing the team’
- Looked at inefficiencies within the construction industry
- Suggested construction moved away from a adversarial structure and took on more partnering and teamwork.
- Suggested the NEC was adopted more.
What is the Building Safety Regulator?
- A new regulator
- Will have 3 main functions:
- 1) Overseeing the safety and performance of buildings
- 2) Helping and encouraging the built environment industry to improve competence
- 3) Leading implementation of the new regulatory framework for high rise buildings.
What are your views on the digitalisation of the Construction Industry?
• Drastically required, the construction industry Is inefficient and has not evolved compared to other industries like manufacturing.
What steps have you taken to mitigate any impact of Brexit?
- We have a Brexit main contract risk
- I implemented a BREXIT Tracker, which is issued to critical trades who list out their contact details and locations of their suppliers.
- Held a workshop with Internal timber Doors (Coming from the republic of Ireland) to discuss the shipping process and paperwork.
- There is a resilience supply chain tracker which is submitted to the Client every two weeks with updates.
What are some industry criticisms of the construction playbook?
• All governments have published their own strategies and reports with construction, and few have made any real tangible differences.
What is the Coronavirus ACT?
- Granted the Gov emergency powers to handle the COVID 19 Pandemic
- Allowed them to implement ‘lockdowns’ – bad for construction!
What is DRC?
- VAT rules for firms within the CIS (Construction Industry Scheme).
- Contractor pays HMRC the VAT directly on behalf of the Sub-Contractor.
What is the Health & Safety Act 1974?
• Places a duty on employers to ensure health and safety, wellbeing of employees is ensured, so far as is reasonably practicable.
Who is DRC exempt?
- Design fees

What is IR35?
- Came into effect on April 21
- Determines how an independent Contractor should be taxed.
- If an individual falls inside IR35 they will be taxed and pay contributions the same way as an employee.
With rising COVID rates, what would you do if the Gov was to implement another lockdown and how does the contract deal with this?
- Sub-Contracts at Norwood have an amended clause, that after ‘Force Majeure’ in relevant event, it does not include the reoccurrence of any impact of the Covid-19 virus.
- Covid is not force majeure as it’s a known event now
- Main Contract has an amended clause that if the Gov implement restrictions then that is a relevant event.
