  • Ensure fluctuations are agreed in the contract.
  • If the Contractor is to retain the risk of material price increases, they may demand high lump sum fees for this. However, the risk is that the Subcontractors do not agree to this and the contractor bares the risk.
  • There is an increase in materials off site and advance payment bonds being used. (read in the modus journal).
  • Use provisional sums
  • More letters of intent are being used and pcsa’s.

  • I implemented a BREXIT Tracker, which is issued to critical trades who list out their contact details and locations of their suppliers.
  • Held a workshop with Internal timber Doors (Coming from the republic of Ireland) to discuss the shipping process and paperwork.
  • There is a resilience supply chain tracker which is submitted to the Client every two weeks with updates.

  • Sub-Contracts at Norwood have an amended clause, that after ‘Force Majeure’ in relevant event, it does not include the reoccurrence of any impact of the Covid-19 virus.
  • Covid is not force majeure as it’s a known event now
  • Main Contract has an amended clause that if the Gov implement restrictions then that is a relevant event.

Compliment each other.

The Fire Safety Act: Amends the fire safety order (regulatory reform order 2005) And details who is accountable for reducing the risk of fires.

The Building Safety Bill: Changes the responsibilities of those involved in the construction process, including different requirements for high level buildings 18m and the introduction of the Building Safety Regulator.

  • The Royal Institution of Chartered Surveyors (RICS) Governing Council has appointed Lord Michael Bichard to lead an independent review into the Institution’s Purpose, Governance and Strategy.
  • The Bichard RICS Review will make firm recommendations on the purpose and governance structure of RICS, and provide advice on values, culture and strategy for an incoming leadership team and Governing Council to take forward.
  • Called for evidence in Jan 22. And is expected to publish the report in June 22.

  • RICS have stopped accepting any payments or providing any services to members and firms in Russia.
  • They have not revoked membership as that would be unethical.
  • RICS produced Anti-Money Laundering document in March 22 to give advice given Russian sanctions.
  • Complying with sanctions is both a legal and ethical obligation, and there can be serious consequences for failures to do so.
  • Lionheart is providing support to Ukrainian refugees.
