What is a Gladue Report

A

A Gladue report is a pre-sentence or bail hearing report that provides information about an Indigenous person’s background and experiences with colonization, racism, and discrimination. The report is used to help judges consider the unique systemic factors that may have contributed to the offender being brought before the court.
Gladue reports can be requested by the Crown, defense lawyer, court, or the Indigenous offender themselves. The Indigenous offender must agree to the report being prepared.

What is Gladue Court

A

The Gladue Court at OCH is a sentencing and bail hearing court that takes a case management approach. While the Gladue Court itself is not set up too differently from other OCH courts, it aims to incorporate Indigenous values, principles, and conceptions of justice into court processes and proceedings.
