where do exemptions from licence requirements occur?
police can possess, transport, store substances or equipment if it is to enforce the act
-same with servicing if it is to enforce the act
-must immediately inform commission
are naturally occuring nuclear substances exempt from the Act?
yes, but not from provisions that govern transport of nuclear substances, and import/export provisions
conditions whereby commission can grant exemption?
as long as doing so will not:
- pose unreasonable risk to health, environmental, national security
-mean that Canada won’t meet it’s international obligations
obligations of licensees
-ensure enough qualified workers
-train the workers
-take all reasonably precautions to protect environment, health etc
-provide and maintain devices required by the Act and maintain them within Act’s specifications
-everybody must use equipment etc in accordance with the act
-take all reasonable precautions to control release of radioactive nuclear substances etc.
-implement measures for alerting the licensee to illegal use of nuclear stuff
-implement measures to alert license to sabotage
-ensure Canada is complying with safeguard agreements
-instruct workers on physical security program at site of licensed activity
-keep a copy of the Act available to workers
what does the licensee have to do if the commission asks for a certain test etc?
-confirmation if test will or will not be carried out, or carried out in part
-action licensee took
-reasons why any part won’t be carried out
-proposed alternatives to achieve objectives of request
-proposed alternative period for licensee to do the request
-report must be filed within time specified in request
