can the commission renew a license on its own motion?
yes, if failure to renew license could pose unreasonable risk
for what condition can the commission revoke or suspend a license?
- licensee is not qualified
- licensed activity poses unreasonable risk
- licensee failed to comply with Act
- licensee has been convicted of offense under act
- record referred to in license has been modified in a manner not permitted
- licensee no longer carries on licensed activity
- licensee didn’t pay license fee
- failure to do so could pose a risk
where do exemptions from licence requirements occur?
police can possess, transport, store substances or equipment if it is to enforce the act
- same with servicing if it is to enforce the act
- must immediately inform commission
are naturally occuring nuclear substances exempt from the Act?
yes, but not from provisions that govern transport of nuclear substances, and import/export provisions
conditions whereby commission can grant exemption?
as long as doing so will not:
- pose unreasonable risk to health, environmental, national security
- mean that Canada won’t meet it’s international obligations
obligations of licensees
- ensure enough qualified workers
- train the workers
- take all reasonably precautions to protect environment, health etc
- provide and maintain devices required by the Act and maintain them within Act’s specifications
- everybody must use equipment etc in accordance with the act
- take all reasonable precautions to control release of radioactive nuclear substances etc.
- implement measures for alerting the licensee to illegal use of nuclear stuff
- implement measures to alert license to sabotage
- ensure Canada is complying with safeguard agreements
- instruct workers on physical security program at site of licensed activity
- keep a copy of the Act available to workers
what does the licensee have to do if the commission asks for a certain test etc?
- confirmation if test will or will not be carried out, or carried out in part
- action licensee took
- reasons why any part won’t be carried out
- proposed alternatives to achieve objectives of request
- proposed alternative period for licensee to do the request
-report must be filed within time specified in request
can licensee transfer a nuclear substance to a person who does not hold the license to possess the substance?

what must licensee do in terms of representatives of licensees?

what are prescribed equipment?
- package, special form radioactive material etc that has basic radionuclide value that is not listed in IAEA regs
- radiation device and sealed source
- class II prescribed equipment
- equipment that can be used in design, production etc of nuclear weapon
what is prescribed information?
info that concerns any of the following:
- nuclear substance
- deisgn, use etc of nuclear explosive device
- security arrangements etc established by licensee
- route or schedule for transport of category I,II, or III material
- info made in public in accordance with the Act
who can use and import/export prescribed information without a license?
- minister or person acting on behalf of gov of Canada
- foreign gov official for the purose of meeting obligations between gov of Canada and foreign agency
who can use (but not import/export) prescribed info without a license?
- worker- to do duties as assigned by licensee
- person legally authorized to obtain information

- event that will result in exposure to persons greater than radiation dose limits
- unauthorized release of radioactivity into environment

- failure of degradation of something at the licensed facility that may be a risk
- actual, threatened, or planned work disruption by workers
- serious injury or illness due to licensed activity
- death at a nuclear facility

how long do you have to file report to the commission?
21 days after becoming aware of it
what will the report to the commission include?
- date, time, location of becoming aware
- describe situation and circumstances
- probable cause of situation
- effects on environment, health etc
- effective and equivalent dose received by any person as result of situation
- actions license has or will take wrt situation
under what conditions and when must one file a safeguards report?
- prelimimnary report immediately
- full report within 21 days of awareness
- interference with or interruption in operation of safeguards
- theft, loss, or sabotage of safeguards equipment
what info is included in safeguards report?
- date, time, location of becoming aware
- describe situation
- probably cause of situation
- adverse effects on environment and people etc
- effective and equivalent dose received by any person as a result of situation
- actions licensee has or will take
what does licensee do upon discovering a deficiency in record?
- file report within 21 days
- include details of error
- action licensee has or will take wrt error
doesn’t apply if error could not reasonably be expected to lead to a situation where environment, health etc are affected
what is the date of filing of a report?
date it is received by the commission
what do inspectors and designated officers have?
-certificates indications, name, photo, designation, name/signature of person who issued certificate, expiry date
when do inspectors/designated officers surrender their certificate or notify the commission?
- theft/loss of certificate
- change in employment such that certificate no longer needed
- suspension or termination of emplyment that requires certificate
- if certificate has errors
- certificate exposres
- commission terminates them
