Outline the offence of outraging public decency contrary to Common Law
It is an offence to commit an act of lewd, obscene and disgusting nature,
which is capable of outraging public decency in a public place
where at least two members of the public could have witnessed it.
Can be men or women
Does not need to be a sexual act
Exposure of naked body parts must go beyond limits of decency.
Must be in a public place.
Lewd - lustful or indecent
Obscene - Morally repugnant
Disgusting - Repugnant
Define Section 66 Sexual Offences Act 2003
A person intentionally exposes their genitals
AND
they INTEND that someone will see them and be caused alarm or distress.
Define Voyerism
A person observes another doing a PRIVATE ACT for the purpose of obtaining sexual graification and they KNOW that the other person DOES NOT CONSENT to being observed for their sexual gratification.
Outline the x3 sections of Voyerism under Section 67 Sexual Offences Act 2003
67(2) - Operating equipment with intention of enabling another person to observe private act for others sexual gratification. i.e landlord operating webcam to allow people on internet to view.
S67(3) - Recording another person doing private act with intention of looking at recording for own sexual gratification or intending other people to look for their sexual gratification.
S67(4) - Installing equipment or adapts structure or part of a structure with intention of enabling self or another to commit offence under S1
