Outline the offence of outraging public decency contrary to Common Law

A

It is an offence to commit an act of lewd, obscene and disgusting nature,

which is capable of outraging public decency in a public place

where at least two members of the public could have witnessed it.

Can be men or women
Does not need to be a sexual act
Exposure of naked body parts must go beyond limits of decency.
Must be in a public place.

Lewd - lustful or indecent
Obscene - Morally repugnant
Disgusting - Repugnant

Outline the x3 sections of Voyerism under Section 67 Sexual Offences Act 2003

A

67(2) - Operating equipment with intention of enabling another person to observe private act for others sexual gratification. i.e landlord operating webcam to allow people on internet to view.

S67(3) - Recording another person doing private act with intention of looking at recording for own sexual gratification or intending other people to look for their sexual gratification.

S67(4) - Installing equipment or adapts structure or part of a structure with intention of enabling self or another to commit offence under S1
