Define Section 76 Serious Crime Act 2015 (Coercive Control)
A range of act designed to make a person subordinate and/or dependant by isolating them from sources of support, exploiting their resources and capacities for personal gain, depriving them of the means needed for independence, resistance and escape, and regulating their everyday behaviour.
Define the offence of coercive control
(A) repeatedly or continuously engages in behaviour towards anther person (B) that is coercive or controlling
AND
At the time of the behaviour (A) and (B) are personally connected,
The behaviour has a serious effect on (B)
(A) knows or ought to know that the behaviour will have a serious affect on (B)
What constitutes coercive behaviour?
Behaviour to make the victim:
Dependant/subordinate
Isolated
In fear or or actual violence
In fear of consequences
Humiliated, frightened, punished, degraded
Controlled
Explain what is meant by “personally connected”
They are or have been married or civil partners
Have agreed to enter civil partnership or marriage
Are or have been in intimate relationship
Are relatives
Have or are in parental relationship over a child
What is meant by “serious effect” in coercive control
Behaviour causes victim to fear on at least x2 occasions that violence will be used against them
Causes the victim serious alarm or distress which has had a substantial affect on their day to day activities
What is the sentencing for Coercive Control
Either way offence
Indictment - imprisonment up to five years
Summary - Imprisonment up to 12 months + fine
What are the statutory defences of coercion control?
(A) believed to be acting in the best interest of (B)
The behaviour in all circumstances was reasonable
