Fitness to Stand Trial
The bar for standing trial is very low
1. Must understand the nature or object of the proceedings
2. Must understand the possible consequences of the proceedings
3. Must be able to communicate with counsel
Not Criminally Responsible (NCR)
The person is incapable of appreciating the nature and quality of the act or knowing that it was wrong.
Appreciate = an ability to foresee and measure consequences
Wrong = legal and moral wrongness
Acute intoxication can never make someone NCR
Medical Negligence
The 4 D’s
- Duty of care (the physician was responsible for the patient)
- Dereliction of duty (performed less than standard of care)
- Direct causation (if not for the dereliction, injury would not happen)
- Damage (must be demonstrated)
Informed Consent
Consists of telling the patient (or alternate decision-maker) the following:
- Diagnosis
- Treatment (nature and purpose)
- Consequences (risks vs. benefits)
- Alternatives (viable alternatives)
- Prognosis (outcome projected with and without Tx)
Exhibitionism
A type of paraphilia.
Exposure of one’s genitals to an unsuspecting stranger.
Voyeurism
A type of paraphilia.
The act of observing an unsuspecting person who is naked, in the process of disrobing, or engaging in sexual activity.
Fetishism
A type of paraphilia.
The use of non-living objects.
Frotteurism
A type of paraphilia.
Touching and rubbing against a non-specific person.
Sexual Sadism
A type of paraphilia.
Acts in which the psychological and physical suffering of the victim is sexually exciting.
Transvestic
A type of paraphilia.
Cross-dressing heterosexual; arousal from cross-dressing.
Paraphilia
A relatively stable pattern of sexual arousal to inappropriate stimuli.
All must be over 6 months in duration.
