Assessing risk of violence
Historical factors -> previous, psych, substances
Clinical factors-> delusions and hallucinations, thoughts and plans to harm , fantasies , insight
External factors-> access to victims and methods
Have a responsiblity to warm potential victims
Fitness to plead
Mental health at time of trial Must have capacity to: Understand the difference between pleas of guilty and not guilty Understand the charge Instruct counsel Follow evidence Challenge juror
Insanity
Absence of intent at time of offence
Such a defect of reason from disease of the mind not to know the nature and quality of the act
Did not know it was wrong
Leads to acquittal
Diminished responsibility
Only applies to murder
Reduces charge to manslaughter
Impaired mental responsibility
Automatism
Absence of intent when the mind does not have the potential to control physical acts
Organic causes
Forensic schizophrenia
X4 increased risk of violent act
Usually minor offences that are manifestations of impaired social skills
More likely to be victims
