When can you conduct a Forensic Procedure on a suspect (not 10-17)?

A

Person is a suspect
Person is not a child or incapable person
Reasonable grounds to believe the procedure may prove or disprove the suspect committed an offence
‘Forensic Procedures Information Sheet- Suspect”:
1. Read it to them
2. Ask them if they understand
3. Ask them if they wish to exercise any of their rights
4. Ask them if they wish to seek legal advice
5. Ask them to consent to the forensic procedure

When do you require a Senior Police Officer order in relation to conducting a Forensic Procedure?

A

When the suspect is under arrest and they do not consent to a non intimate forensic procedure. Must show reasonable grounds to believe that the carrying out of the forensic procedure might provide evidence that may prove or disprove the suspect committed an offence.

Can a child 10-17 or incapable person consent to a forensic procedure? Explain.

A

They cannot consent to a forensic procedure.
Must apply for a court order.
Must show reasonable grounds that the FP will prove or disprove the person committed the offence and the evidence will have probative value.
