Firearms Definition
- A lethal barrelled weapon of any description
- From which any shot, bullet or other missile can be discharged and includes:
Any prohibited weapons, lethal barrelled or not
Any component part of such lethal or prohibited weapon
Any accessories which are designed or adapted to diminish the sound or flash caused by firing the weapon
Air Weapon
An airweapon, that is to say an air rifle, air gun or air pistol which does not fall within section 5(1) of the firearms 1968, and
1) the component parts of an air weapon
2) any accessories designed or adapted to diminish sound of weapon
Ammunition
Any ammunition for any firearm and includes:
- grenades, bombs and other like missiles
- whether capable of use with a firearm or not
Shotguns
A shotgun is a smooth bore gun, not being an air weapon, which;
- has a barrel length not less than 24 inches in length
- a barrel bore not exceeding 2 inches in diameter
- must not have a magazine capable of holding more than two cartridges
NOT LESS THAN 24 inches
NOT MORE THAN 2 inches
NOT MORE THAN 2 cartridges
Prohibited Firearms
5(1) Firearms Act 1968
- All firearms and rifles designed or adapted for rapid fire
- Rapid fire shot guns with an overall size small enough to make them easy to conceal
- Any firearm disguised as another object
- Rocket launcher or other projecting apparatus for use with explosive rockets by military
- Air weapons that use self contained gas cartridge system

Fire arms - Public places - Section 19
- Loaded shotgun
- Air Weapon (whether loaded or not)
- Any other firearm if person carrying ammunition
- Any imitation firearm whether capable of discharge or not
Trespass private land and water - Section 20
In possession of a firearm or imitation to trespass onto any land or buildings without reasonable excuse.
Fire arms - Stop and Search - For Section 19 and 20
Section 47
Constable has reasonable reason to suspect that a person is in possession of a firearm or ammunition for a section 19 or about to commit a section 20:
- require person to hand over firearms and ammo for examination
- search and detain person for that purpose
- stop and search any vehicle in similar circumstance
- enter any place

Criminal Offences - Section 17 and 18
Section 17
1) for any person to use in any way, a firearm or imitation firearm
- with intent to resist or prevent arrest of themselves or others
2) to be in possession a firearm or imitation
- whilst committing or being arrested for a schedule 2 offence
- unless possession lawful
Section 18
Above - but INTENT TO COMMIT - schedule 2 crime
Possession is genuinely enough to charge
Air weapons and Licensing Scotland Act 2015
Section 30
- Fail to take reasonable precautions for safe custody of an air weapon
- fail to report the loss or theft or air weapon asap
Firearms Act 1968 section 21A
Offence for any person to have an air weapon on any premises and fire it outwith premises
Firearms or shotgun section 1 with certificate - Under 18s
Need license and certificate and use only for:
- Slaughtering
- sporting and competition
- vermin/estate control
- practise for sport or competition

Cannot:
Purchase firearm or ammunition
Section 24
Cannot sell or hire any firearm to an under 18
