Constitution

A
  • Our Constitution creates a federal structure by giving the Commonwealth exclusive powers (s. 52), establishing a set of concurrent powers (s. 51), and granting State Governments the remaining (residual) authorities
  • S109 - When state and federal laws conflict, the federal law prevails
  • In essence, this means that the Commonwealth has sole authority to use the s. 51 powers
