Fault generally implies a sense of blameworthiness or responsibility for ones wrong doing.

In this sense it also refers to the mental state of the defendant.

The basic principle is that the defendant should be able to contemplate the harm that his actions may cause and should therefore aim to avoid his actions

Fault is an essential element of quite diverse element of law
