Explain party control
Each party has control of their own case and decides:
- what sort of evidence to bring out
- how many witnesses to call
- how to investigate facts
Explain the role of the judge
Ensures the case is conducted in the correct manner and both sides are treated fairly
Describe rules of evidence
Ensures that only the evidence relevant to the case is heard by the court
Describe equal representation
Each party should be represented by by someone with equal skill and efficiency to the other
Name two advantages for adversary system
Relies on oral evidence- better able to tell the truth
Truth should emerge- both sides strive to win
Name 2 disadvantages for the adversary system?
High cost- must hire best legal representation to win
Unequal representation- parties can be disadvantaged if representative isn’t prepared
