ethics and law Flashcards
utilitarianism
maximize human welfare
doesn’t matter whose welfare
one person can suffer in order for more to be helped/happy
so: save the 6 not the 60 year old, practice in an undeveloped country, and torture a person to get info that will help a group
Kantian/deontology
never lie, even when the murderer asks for theperson hiding in your basement
the maxim is everything (alniyyah)
respect the individual human
the endsare important, never treat anyone a a mere “means” to an end
virtue
the right thing to d is what a virtious person might do.
But how do we know what that is?!
casuistry
case based reasoning.
base decisions on similar situations in other contexts
uses analogies
narrative based medicine
like casuistry, case based, but richer more personal stories
you each ethics through patient’s stories.
research ethics principles
respect for persons= autonomy, consent(the standard is higher than just clinical consent), protect the vulnerable
benefecience= therapeutic equipoise, placebo only acceptable if there is no known agreed upon Tx
justice= you can’t do a study oninpatients just cuz it’s convenient. it has to benefet the subpopulation.also, if there is no reason to exclude women and children then don’t cuz it’s not fair to deprive them of the benefit of the research. developing countries too
research on children
parents decide
get child’s assent at age 7
minimal risk only is allowed
for older ppl similar.
