Ethical issues related to death and dying
Clients have the right to choose tx options
Can give directions about the care they want or dont through Advance Directives
Clients who may may die soon should have POLST- Physician for
Life Sustaining Tx.
Bx that might propel decline are not considered suicidal bx i.e. not eat or drinking when death is near, not taking medications, not sustaining tx
Confidentiality
And Confidentiality with courts
In all instances even when client is threat to self or others THE LEAST AMOUNT OF INFO NECESSARY SHOULD BE GIVEN
Should inform client when disclosures made whether legal or client consent
Do not disclose to 3rd party payer unless client authorizes 1.07
When court ordered and believe disclosure could cause client harm
- Request court withdraw order
- Limit the order as narrowly as possible
- Maintain records under seal
With subpoena a sw should claim privilege and not turn over records unless you recieve an order to do so
Dispose of records according to state statutes
If sued by client sw is able to release client info for their own defense LIMIT TO ONLY NEEDED INFO FOR DEFENSE
Parents have access to records depending on age and type of tx setting
Sw treating minors with parents who have joint or limited custody must b aware of all that parents rights to access records
