Does the Common Law require reporting child protection issues as a result of the principal of duty of care?
YES
What is the duty of care principal? (for child protection)
All HP’s have an obligation to report a reasonable suspicion of child abuse and neglect
A child in need of protection..
- Has suffered, is suffering, or is at risk of suffering significant harm
- Does not have a parent able and willing to protect the child from harm
What’s an Enduring Power of Attorney?
Someone to make decisions on your behalf when you lose the mental capacity to do so. (legal document) (can have one attorney or different ones)
What is capacity?
Person’s ability to:
- Understand nature and effect of decisions
- Freely and voluntarily make decisions
- Communicate those decisions in some way

Should always assume a person has capacity.
Capacity is specific to the matter or the decision to be made.
What is an ACAT?`
Aged Care Assessment Team
- (over 65yrs old)
- (can only refer for ACAT if someone consents - so need to determine capacity first)
- (residential care or respite)
- (home care approval)
NDIS??
National Disability Insurance Scheme (under 65yrs)
Who gets NDIS funding?
- Lifelong impairment/condition
- Substantially reduces ability to participate effectively in activities, or perform tasks or actions independently
- Affects capacity for social and economic participation
- Likely to require NDIS support for lifetime
