Why are transboundary river disputes such a problem?
- No solution from international law as laws often contradict each others
- Upstream assert right of territorial sovereignty that it is their water so their decision on use
- Downstream clam territorial integrity that it is their right to receive same amount and quality as have had it in the past
What does the Helsinki principle state?
International treaties must include concepts such as ‘equitable use’ or ‘equitable share’ and be applied to whole drainage basins not single countries
What should water sharing be based upon?
Natural Factors (rainfall, water source, share of basin)
Social and Economic needs (pop. size, development and welfare)
Downstream Impacts (flow restricted, water table lowered, pollution)
Dependency (alterative sources available?)
Prior Use (Past use or potential future use)
Efficiency (Avoiding waste and mismanagement)
What does water transfer mean?
Large scale river diversions or construction of large canals from one basin to another
