What is a conditional release?
Means of leaving a correctional institution before warrant expiry where offender is subject to conditions that if breached triggers revocation and return to prison
What are the attributes of probation?
Ordered by a judge at sentencing, up to 3 years, violations doesn’t automatically lead to incarceration (a new charge is laid)
What are the attributes of parole?
Granted by parole board, allows proportion of sentence to be served in the community, begins with release ends at warrant expiry date, violations may result in revocation of parole
What are the only two provinces with provincial parole boards?
Quebec and Ontario
What is the purpose of conditional release?
To maintain a just, peaceful, and safe society by the decision on timing and conditions of release to help offenders reintegrate into the community as law-abiding citizens
What are the conditions of parole?
Offender will not be reoffending or present risk to society and offender is a law-abiding citizen
What are the three points in a sentence where an offender can be released?
Parole eligibility date (day or full parole), statuary release date (2/3 point in a sentence), warrant expiry date (end of sentence)
What is cold turkey release?
Discharge from custody without conditions or supervision
What are the 4 release options?
Temporary absence (escorted and unescorted), day parole, full parole, statutory release
What is a release plan?
A plan that sets out the residential, educational, and treatment arrangements made for an inmate who is applying for conditional release
What is the community assessment?
An evaluation of the feasibility of the release plan, the level of supervision required, and the availability of community resources
What are the issues in parole board decision making?
Boards may be subject to influence, lack of feedback about results of decision, absence of clarity
What is reintegration?
A process where an inmate is prepared for release into the community to avoid reoffending
What are the pains of re-entry for offenders?
Everything is fast paced and unpredictable filled with choices, employment, housing, education, and require access to programs and services
What are the criminogenic needs of offenders?
Community functioning, employment, family, personal and emotional, associates, substance abuse, attitudes
