Blood 81 and over loss of license/$4500 fine or both.
Blood 51 - 80 $200 infringement and 50 demerit points
IF TAKEN AFTER FAILING OR REFUSING EBT - $700 infringement
What is the breath alcohol limit for 19 and under?
Breath 151 and over loss of license and/or $2250 fine.
Breath any alcohol detected 150 and under $200 infringement fee and 50 demerit points.
Blood limit 19 and under?
Blood of 31 and over 3 months loss of license and possibly both $2250 fine.
Blood of 30 and under infringement fee $200 and 50 demerit points
What is the first step in the procedure?
Conduct a passive breath test to establish the presence of alcohol. If there is then say “I require you to undergo a breath screening test without delay”.
Verify the age of the driver.
What happens if a driver blows 252 or over in a breath screen test?
Say “I now require you to accompany me to _______ or any other such place for the purpose of an evidential breath test, blood test or both.
As you are now detaining them you need to say “You have the right to remain silent and do not have to make any
statement.
Anything you say will be recorded and may be given in evidence in
court.
You have the right to speak with a lawyer without delay and in private
before deciding whether to answer any questions.
Police have a list of lawyers you may speak to for free.”
