PO can’t accept if know or shd know to influence.
What employment can PO accept?
DUAL EMPLYMT
- Job existed or created w/o kwlg of PO’s interest.
- Job publicly advertised;
- PO subj to same application and hiring process.
- PO meets or exceeds qualifications.
What if PO publicly employed @ election?
May not advance (if offered b/c PO), but can continue.
Companies PO/PE can’t work for.
Can’t work for company regulated by the agency or that has business w/ the agency or that creates a recurring conflict.
Ex. PO is a carpenter for construction company. Is that a conflict?
Analysis:
(1) requiring inspection is not ‘regulation’ so that doesn’t apply.
(2) If construction company does business w/ agency, YES = conflict.
Exception
The company you work for can do business if done on rotation, competitive bidding.
Advisory Board Mbrs impacted?
Yes, advisory board mbr has to publicly disclose & conflict can be waived by 2/3 vote of the appointing body.
Split the difference b/w dual employment & doing bus with.
Regulated or d/b/w & SPOC Materials, Inc.
