How is an accident defined?
motor vehicle or revenue generating vehicle, involving loss of life, citation issued by investigative jurisdiction, with either property damage or a transport to the hospital
How is a commercial vehicle defined?
> 26,001 pounds or more
Designed to transport 16 including driver
Any vehicle used to transport Haz-Mat
What is a “Covered Employee?”
Anyone who is required to drive, operate or maintain a commercial vehicle
What is a positive alcohol test?
.02% or higher at the time of test
What is a refusal?
Failure to comply with the testing process
What is listed as prohibited conduct?
Report to duty .02% or higher
Possess alcohol on duty
Consume alcohol on duty
Consuming alcohol or drugs within 8 hours of work
Refuse to submit to a random or post accident test
Report for duty under the influence of controlled substances
Annually how many will get tested for alcohol and controlled substances?
25 % annually for alcohol
50 % annually for controlled substances
What observations are made for “Reasonable Suspicion” testing?
Based on specific observation concerning: Appearance Behavior Speech Body Odor Indications of chronic use Withdrawl type symptoms
What is the time frame for alcohol testing?
Tested no more than 2 hours after the observation, under no circumstances will it be more than 8 hours
What are the post accident testing procedures?
Tested for alcohol from 2-8 hours and controlled substances with in 32 hours
When returning to work, what is the minimum amount of tests in the first 12 months?
6 is the minimum
How long can the follow up testing be done for?
Up to 5 years from the date of returning to work.
