What is an Easement?
The right held by one person to use the land of another person for a specified purpose.
What does Ingress mean?
To Enter
What does Egress mean?
To Exit
What is an Appurtenant Easement?
Involves two properties owned by two different owners.
What are the two properties involved in an appurtenant easement called?
Dominant & Servient Tenement
What is a Dominate tenement?
They are dominating, therefore they are in charge.
What is a Servient tenement?
They are serving, so the servient tenement is “serving” the dominant tenement’s purpose.
What is Easement in Gross?
No dominant tenement because the people crossing the land are not using it to get the anther property. (Ex electric companies)
What is an Easement by Necessity?
Created by the court to issue access to someone who must cross someone else’s land to gain access to their property.
What is an Easement by Prescription?
Created by the actions of one person against the interests of another person.
