What are damages?

A
  • Damages is an amount of money awarded to the plaintiff, to be paid by the defendant. These can include compensatory, nominal, contemptuous and exemplary damages.
  • The purpose of damages is to return the plaintiff to the position they were in before the defendant caused them harm or loss.

What are compensatory damages?

A
  • These are the most commonly sought after damages
  • The purpose of damages is to restore the party whose rights have been infringed, as far as possible into the position they were in before their rights were infringed by compensating them for loss suffered.
  • it may be difficult to achieve its purpose when someone has suffered physically, but money may compensate for their losses
