What are the police powers under section 42?
Any police who believe on reasonable grounds that it is critically necessary to protect a CYP from injury or death
May enter and search by force if necessary any place and remove or detain the CYP and place them in CYFS custody
Define a child or young person in need of care and protection
A child or young person in a situation where:
- they are likely to be sexually, emotionally or physically abused or neglected.
- there are serious differences between a child or young person and guardian that affect wellbeing.
- the guardians are unable or unwilling to control the child or young person
- a child aged 10 - 14 is offending to such an extent there is concern for their wellbeing.
What are the powers under section 39?
Any person authorised by warrant under section 39 may enter and search by force if necessary any place if they believe on reasonable grounds that the CYP:
Has suffered
Or is likely to suffer
Ill-treatment, serious neglect, abuse, serious deprivation or serious harm
Remove or detain the CYP and place in CYFS custody
What is the police powers under section 48?
Where a CYP is found by police unaccompanied
By a parent, guardian or other person who usually cares for them
In a situation where their:
Physical or mental health is being, it likely to be Impaired
Police can take the CYP and deliver them into custody of a parent, guardian or other person.
If no consent or unable then place them in CYFS custody
