What is the responsibility to parents under section 8 of CYF act?
Parents have the right to be informed of any action that affects their children
In relation to CYF what does section 9 outline?
CYP + their caregivers have a right to receive info in a language they understand. An interpreter may be necessary
In relation to CYF What does section 215 outline?
- when a CYP must be informed of their rights
- explained in an appropriate manner/to their age
- before being questioned
When must a CYP be informed of their rights ?
- reasonable grounds to suspect
- before asking questions for admission
- during questioning cop forms reasonable grounds to suspect
- during questioning, decided to charge
- arresting
- CYP being questioned makes an inquiry related to explanation of rights
What are the EXCEPTIONS to the into given to CYP?
1) rights explained in previous hour
2) breath/blood alcohol provisions
3) immigration act procedures
In relation to CYF When is a warning not appropriate? (section 209)
1) seriousness of the offence
2) previous convictions (nature/number)
CYF- Who administers the warning?
The officer, or arrangement of any other person
Explain what is meant be admissibility of evidence of warnings in relation to CYF
Only the defence may disclose that the CYP has been warned or cautioned in the past
Under section 214, what are the considerations for an arrest of CYP?
NO ARREST FOR A CYP, Unless;
W.E.E.P
Witnesses- prevent interference
Ensure - CYP appears in court
Evidence- prevent loss or destruction
Prevent - further offences
CYF- When must an offence be reported to the commissioner?
Within 3 days

1) past guardian
2) adult member of family
3) any other adult selected by CYP
