What are the care & protection principles ?
1) well being of child is entwined with that of the family
2) child’s well being is promoted through family
3) child is to be severed from the family to the least extent
Section 6 CYP - paramount principle
The welfare & interests of the CYP shall be the first & paramount consideration
CYP- What are the statutory obligations under section 42?
- used when needing to act immediately
1) produce ID
2) state the section (sec 42 of the CYPF act 1989)
3) inform commissioner within 3 days
CYP found unaccompanied- section 48
- most commonly used, used in serious circumstances
- found by police unaccompanied
- physical or mental health likely to be impaired
- member of police TAKE or DELIVER them to parents/guardian
- place them in CYPFS if caregivers unwilling
Explain section 10B - children left home alone/outside pubs
- being a parent/guardian of a child under 14
- leaves that child
- without making reasonable provision for the supervision and care of that child
- for a time that is unreasonable or under conditions that are unreasonable having regard to all circumstances
What is the purpose of section 10B?
To ensure that parents/guardians make adequate arrangements for the child’s temporary care
