Crime And The Law #4: Criminal Justice Flashcards
“Describe, in detail, 2 different ways that Scottish courts can punish people (6)”
One way that the Scottish court can punish people is by giving them a prison sentence.
This means that based on the severity of the crime they are made to serve time in prison.
Evidence of this is that 7224 convictions in 2020-21 resulted in a prison sentence (Scotland).
One way that theScottish court can punish people is by fining them. This means that less serious crimes can result in the accused being made to pay a certain amount of money depending on the nature of the crime. Evidence of this is that the justice of the peace court can fine a maximum of £2500. (Scotland)
“Describe, in detail, 2 ways that Scottish courts are effective in tackling crime (6)”
One way that the criminal courts in Scotland are effective in tackling crime is through compensation. This means that victims can receive money which has been taken from the offenders in the form of recompense. Evidence of this is the Victim Surcharge Fund, used to gather proceeds from offenders, and can meet costs that would not have been incurred if the person was not a victim of crime. (Scotland)
One way the criminal courts in Scotland are effective in tackling crime is through prevention. This means that perpetrators can be restricted to or from a specified place to reduce the chance of them recommitting crime. Evidence of this is Restriction of Liberty Orders (RLOs), which require an offender to be restricted to/from somewhere for an amount of time determined by the court, and can include the use of electronic monitoring (tagging) of the perpetrators. (Scotland)
“Describe, in detail, two roles of the child’s hearing system.” (6)
One role of the children hearing system in Scotland is that it can deal with young people who are committing offences. This means that children who have offended can be monitored by local authorities. Evidence of this is that some children can be given a supervision order.
Another role of the children’s hearing system in Scotland is to work with outside agencies to meet the needs of the child. This means that children who have offended can address their actions with assistance. Evidence of this is that some children can be sent to specialist programmes for their behaviour.
