what are the three types of court ?
justice of the peace, sheriff court, high court
what are the max punishment each court hands out ?
JP- max £25000 and 69 days SC- summary= £5000 and 12 months solemn= unlimited fine and 5 months high court= unlimited all
what does the justice of the peace court do ?
justice of the peace is in charge of the court, minor crimes. traffic crimes. use summary procedure, judge decides whether they are guilty and sentence.
what does the sheriff court do ?
sheriff is in charge of the court, deal with minor crimes, drug possession and serious crimes, assault. minor crimes judge decides on guilt (summary). while serious crimes a jury of 15 people decides (solemn procedure). in both judge decides sentence.
what does the high court do ?
high court judge is in charge of the court, deal with most serious crimes like murder. solemn procedure. guilt is decided by jury. judge decided sentencing.
what is community pay back ?
offenders do unpaid work to pay back the cost of the crime they have committed. they pick up litter, clean graffiti and do other unskilled work.
what is tagging ?
used together with curfews. monitors whether or not your at home.fitted around ankle. connects to base station, sounds alarm if offender goes too far away from it.
what is restorative justice ?
the offender meets the victim. talk about what happened and the impact and how thy can’t sort it out. the offender and victim agree on how ty can repair the harm. apology, money, charitable donation.
are the alternatives to prison effective?
CPBO- twice as effective at reducing reoffending
ET - three times cheaper than prison sentence, let’s offender get on with their life
RJ- 85% of victims say it helped them move on with their lives, includes them in the process
what is the mental impact on a victim ?
victim may suffer mental trauma, may feel unsafe and unwilling to go to the place they were attacked. harder to fix than physical trauma
what is an example of mental impact in a victim ?
impact of violent crime - PTSD, which can make a victim relive events
what is physical impact on a victim ?
suffer physical damage, violent crime, different life due to disability of scarring, unable to work
what is an example of physical impact ?
acid attacks- london. easy to get hold of. leaves victims with serious scaring, blindness, disfigurement.
what is a lack of future prospect ?
perpetrator finds it hard to get work. may loose friends or their driving licence.
what is an example of lack of future prospects ?
jobs don’t hire anyone with a criminal record , studies say that some criminals with a record end up living in poverty.
