What is a coroner?
A person appointed to enquire into the manner of death.
A Coroner is equivalent to what?
A district court judge.
What deaths MUST be reported?
SCUMBIE:
- Suicide.
- Cause unknown or NO doctors certificate issued.
- Unnatural or violent.
- Medical.
- Births.
- Institutional.
- Enactments.
Under S.15 CA06, who must police report death to?
NIIO - National Initial Investigation Office.
What is the purpose of a post-mortem?
To determine cause of death.
Under S.33 CA06, what can a family member object to?
A post-mortem.
When MUST a Coroner hold an inquest?
SIC:
- Suicide.
- Institutional deaths.
- Coroner not satisfied.
What is the FIRST purpose of a Coroners inquiry?
- Fact.
- Identity.
- Cause of death.
- Where and when the death occurred.
- Circumstances of the death.
What is the SECOND purpose of a Coroners inquiry?
To make recommendations to prevent similar deaths.
What is the THIRD purpose of a Coroners inquiry?
Refer deaths to other authorities.
When deciding to open an inquiry, the Coroner must have regard to what matters? (6 matters)
- Whether or not the causes appear natural.
- In cases that appear unnatural, was the death caused by other?
- Any existence of allegations, rumors, suspicions, or public interest.
- Will an inquiry reduce chances of similar deaths occurring?
- The desire of other family members to have an inquiry conducted.
- Any other matter the Coroner thinks fit.
