The power you may have…….
This gives you the power to deal with youngsters who are in the street drinking….
Although
It is not an offence for a young person to have alcoholic drink in a public place
and
You are not obliged to confiscate alcohol from underage drinkers
The power should be considered when the drinking causes a nuisance or may lead to further bad behaviour
If you choose to apply this power….
You may confiscate open containers
If you choose to apply this power….
You may confiscate closed containers if you believe they; are, have been, intend to consume alcohol in a ‘relevant place
If you choose to apply this power….
You may also confiscate intoxicating liquor, in open containers, from a person over 18 years of age if you suspect that they are going to pass it to a person who is under 18.
If you choose to apply this power……
You may require the person being in possession of the alcohol to give their name and address.
Officer MUST inform them that:
If they refuse to state name & address or
Refuse to surrender the alcohol,
they commit a summary offence
Section 1 (1AB) A constable who imposes a requirement on a person may, if the constable reasonably suspects that the person is under the age of 16, remove the person to the person’s place of residence or a place of safety.
