Falsche Beweise ggü. Tribunal
a) lawyer knows: darf nicht falsches statement/Beweise machen, muss außerdem adverse legal authority offenlegen, die er kennt selbst wenn sie gegen eigenen client ist
b) learning of falsity: affirmative duty to correct and remedial measures bis conclusion of proceeding (!)
Ausn. bei criminal proceedings nicht wegen Doppelbestrafungsverbot wenn lawyer erst nach conclusion of the proceeding davon erfährt!
c) evidence believed to be false: may refuse to offer,
except criminal defendants testimony (dort muss lawyer den client machen lassen)
d) nonclients bad conduct: shall take reasonable remedial measures, including disclosure if necessary, when lawyer represents client in adjudicative proceeding and knows pof person who intends to engage in fraud etc. related to proceeding
Reporting/snitch
a) other lawyers
1. actual knowledge (personal oberservation or knowledge, oder inferred from circumstances, aber dort reicht nicht mere suspicion, sondern dann muss knowledge accompanied by supporting evidence sein Bsp. nur Gespräch mitgehört reicht noch nicht)
2. substantial question about hoensty etc

Aber wichtige Ausn. does not require disclosure of information otherwise protected by the lawyers duty of confidentiality!!! Bsp. lawyer learned about the midsconduct through protected confidential communications)

Wenn nicht alle Parteien anwesend sind
Communication Verbot
lawyer cannot make any communication that
1. concerns the proceeding
2. is with a person serving in an official capacity
3. and occurs outside the presence and without the consent of other parties
Wie weit reicht Wahrheitspflicht bei Dokumenten, die vor Tribunal verwendet werden?
Grds. dürfen sich lawyers auf Aussage von clients verlassen
Ausn. statement purports to be based on lawyers own knowledge (e.g. lawyers affidavit), dann muss mind. reasonably diligend inquiry durchgeführt worden sein
Respect for rights of third persons
Receipt of inadvertently sent documents
lawyer must promptly notify sender if it relates to representation and lawyer knows/reasonably should know its inadvertently sent

Pflichten bei emergency ex parte communication
Lawyer must inform the tribunal of all material facts known to the lawyer, whether adverse or not, that will enable tribunal to make an informed decision
Mit wem darf lawyer sprechen?
a) represented people: nur mit consent o. authorization
Exkurs: wenn organization der client ist, prohibited from communicatin with organizations constituents (employees etc.), who a) supervise/direct, b) have authority or c) whose conduct ist wichtig
b) unrepresented people: misleading, wenn angeblich disinterested

lawyer may serve as advocate in trial in whcih another lawyer in firm is likely to be called as witness unless witness-lawyers conflict of interest is imputed to firm!
Unsuccessful claims
EVen if a client wishes to pursue a claim, a lwyer may do so only if there is a nonfrivolous basis for doing so! (good faith to develop law)
