Grounds for Denying, Revoking, or Suspending any DPR Certificate or License.

A

DPR is authorized to take action when it is found that an individual or business:

  1. ) Make any false or fraudulent records or reports
  2. ) Fails to adequately supervise the use of a restricted material.
  3. )Fails to comply with the laws and regulations governing pesticides and use.
  4. )Is not a QAL or PCA applicator.
  5. )Does not hold an appropriate commercial pilots certificate.
  6. ) Has violated any provisions of the laws and regulations pertaining to pesticides, DPR or CAC.
  7. ) Fails to notify DPR, in writing, of any change of address.
  8. ) Make false or misleading statements regarding pest control work.
  9. )Fails to make recommendations in writing.

  11. ) Makes a recommendation in a category in which he or she is not licensed.

A

Qualified applicator License (QAL)
(Q3.12)

Required for the person who is responsible for supervising the pest control operations of a licensed pest control business whether restricted materials or general use pesticide are being used. A person with this license may also use or supervise pesticides under a licensed Maintenance Gardener pest Control Business.

  • Pass Laws and Reg Test
  • Additional category examination depending on type of pest control conducted.

Continuous Education

  • Complete 20 hours of DPR approved pest management and instruction within 2yrs.
  • At least 4hrs. pertaining to laws and reg.
  • No grace period.

Exceptions

  • QAL H-Seed Treatment Pest Control-4 hrs DPR approved instruction within 2yrs.
  • At least 2 hrs. pertaining to laws and reg.
  • QAL M, N, P-Antifouling-tributylti; Sewer Line Root
  • Control; and Microbial Pest Control Categories
  • 8hrs. DPR instruction, within 2 yrs, 2hrs. of laws and reg.

QAL responsible for pest control business, must register business with each CAC where they plan to work. Most counties require a fee, with an annual fee.

Pest Control Aircraft Pilot Certificate-(PCAPC)

Requirements

A

1.)DPR Pest Control Aircraft Pilot Certificate
2.) Commercial FAA pilot’s certificate
3.) Medical certificate issued by the FAA
4.) Meet all other FAA req.
There are two types of pilot certificates: Apprentice and Journeyman. In order to earn one must pass exam and demonstrate

2.)Knowledge of the nature and effect of aerial pest control.
3.) Pass laws and reg exam, the Apprentice Pilot Exam, and the Journeyman Pilot exam.

A

13.)Worker restricted-entry interval if one is established; pre-harvest interval; and label restrictions on use or disposition of the treated commodity.
14.)Criteria for determining the need for recommended treatment.
15.) Certification that alternatives and mitigation measure have already been considered and adopted if feasible.
16.)Signature and address of the adviser, the date, and the name and address of the business the adviser represents.
*Adviser must retain a copy of each written recommendation for one year following the date it is signed.

PCA-Continuing Education

Denial, Revocation, and Suspension of PCA

If there are multiple dealer locations, they must have a license for the principal location and each branch location. If the pest control business sells only what they apply then a pest control dealer license is not necessary.

Appropriate Products

Each licensed pest control dealer must sell or deliver a pesticide only when the required written recommendation corresponds to the pesticide label. It is illegal for a pest control dealer to knowingly sell or deliver under any of the following circumstances

  1. )Are used for producing ag. commodities-records of operator id numbers.
  2. )Have active ingredient Clopyralid-for lawn/turf and used in residential, school, park, office building, and golf course settings.
  3. )With active ingredient tributyltin-for ship hulls, outboard motors, and lower drive units.

Quarterly Reports

A

A pest control dealer shall submit to DPR two quarterly reports showing:

  1. )Total sales in dollars and total pounds or gallons of Ag. use pesticides
  2. )A mill tax assessment when the deal is the first to sell into or within California.

Supplemental Label Reccomendation

A

When a written recommendation includes a use that is only found on a supplemental label, the dealer must deliver both the written recommendation and the supplemental label to the applicator in sufficient time so that they may prepare properly.

Dealer Responsibilities and Requirements for Certain Pesticides

Purchasers must provide to the dealer written proof of authority and other documentation related to the purchase of California and Federal restricted use pesticides. Including written proof of the following:

  1. )Restricted material permit for any pesticide that requires one
  2. )Private or commercial applicator licenses
  3. )Operator i.d number issued by the CAC
  4. )Vessel registration form for antifouling paints or coating containing tributyltin.
  5. )Signed statement, attesting to the proper and legal use, from a certified commercial applicator for pesticides that contain clopyralid.

*All records must be readily available for inspection from DPR and CAC.

Pesticide Broker License:

Must have a pesticide broker license (in and out of state) before:

A
  1. )Engaging in the sale of or distribution to sell DPR-registered pesticides within California.
  2. )Sell or distribute to sell these pesticide to another licensed broker.

The following do no require a broker license.

  1. ) Registrants selling their own DPR-registered products
  2. ) Licensed pest control dealers.

Licensed Pesticide Brokers can not solicit a pesticide sale by making an agricultural recommendation, personally or through other (conflict of interest). Brokers cannot do the following

  1. )Sell pesticide for an agricultural use.
  2. ) Sell to control Ag pest through biological agent, lure, insect traps, etc.
  3. )Sell a restricted material pesticides that require QAL.

A broker must maintain four yrs. of purchase, sales, and distribution records; into or with California. Must be available to the CAC or DPR upon request.
Also must
1.)Record total $ of sales and pounds or gallon of pesticides sold into or within California on a quarterly basis.
2.)Record the first sale of any pesticide product into or within California through a mill
assessment report + pay all mill assessments.

No continuing education required.
County Registration is not required

Denial, Revocation, Suspension of Pesticide Broker License

DPR can do the following if:

  2. ) Failing to comply with the laws and regulations

Pest Control Business License:

Is required by anyone who advertises or solicits to, or operates a business to conduct pest control for hire in California. The following activities are exempt.

Each pest control business must have a QAL responsible for the pest control operations of the business. Must have a valid QAL in the category of pest control conducted in the business. This license is for pesticide landscaping in:

1. )Parks
2. )Golf courses
3. )Cemeteries

  1. ) Preservative treatment of fabrics or materials.
  2. )Seed treatment that is incidental to regular business
  3. )Structural pest control
  4. )Household or industrial sanitation services
  5. )Live capture and release of vertebra pests
  6. ) Arboriculture-mending tree diseases (This does not include control of tree pests.)

If you do not engage in regular pest control business however operate in the vicinity of the property, one does no need to pay the pest control business license fee, however still required to obtain the pest control business license to fulfill

Maintenance Gardener Pest Control Business License:

Required for anyone working primarily in maintenance gardening, landscape maintenance, and interior-scape maintenance.

Is also required whenever incidental pest control is done; including the use of snail bait.

If you contract to do landscape maintenance in parks, golf courses, or cemeteries you must obtain a Pest Control Business License (mentioned in earlier flashcards) if your work includes pest control; these settings are not covered under the scope of Maintenance Gardener Pest Control Business License

Pest Control Equipment

Must conspicuously and legibly identify each piece of equipment used for mixing or applying pesticides.

Mark each ground rig, service rig, with either the name of the business or with “Licensed Pest Control Operator””Fumigation Division.

Must also include pest control operator license number or that of the firm and must be readable at 25ft. distance.

Also register each piece of application equipment in the county where you intend to use it. CAC may arrange inspection of equipment at anytime.

Notice of Application

Before performing pest control, must give notice to the operator of the property that you will be treating and receive consent. The operator of property must then give consent and notice to everyone known to be on the property or likely to enter whilst restrictions of entry are in affect. Each notice must include

  2. )Identify the pesticide brand name or common chemical name
  3. ) Adequately advise of the precautions, including restricted entry provisions, from the label.

Pest control businesses are required to obtain from each property operator an operator identification number when the business makes a pesticide application for producing an agricultural commodity

Completion Notice

Pest control business that applies pesticide for the production of an agricultural commodity must give a completion notice to the operator of the property within 24 hrs after completion of pesticide application. Must include

  1. )Location of the property including the site i.d. number, and the acreage that was treated
  2. )Pesticide/s that were applied
  3. )Date an hour that the application was completed.
  4. )Applicable restricted-entry and pre-harvest intervals.

Property operator must also communicate in writing to the pest control business if they can receive the completion notice within 24hrs, and if so, the method of receiving notification including

  1. )Posting or leaving the. completion notice in a designated location on the operators property.
  2. ) Recording the completion notice on a phone answering machine.
  3. )Through fax.

*The pest control business must retain a copy of this notification
Must also maintain a written record of the
1.)Name of the operator of the property that was treated.
2.)Location of the property, including the site i.d. number (obtained from CAC)
3.)Date and time the completion notice was given
4.)Method that was used for notification and name of the person who was notified.

*Record must be retained for 2yrs, and readily available for CAC and DPR

The pest control business must keep available a copy of the written pest control recommendation, and restricted materials permits.

Pesticide Use Records

Are necessary for a pest control business when using any pesticide for agriculture, industrial post-harvest commodity treatment, or outdoor institutional or industrial pest control. Include:

  1. )Date of application
  2. )Name of the operator of the property treated.
  3. )Location of the property treated
  4. )Crop, commodity, or site treated
  5. )Total acreage or units treated
  6. ) Name of the pesticide, including US EPA or state registration number on the pesticide label and the amount used.

When applied for production of Ag. commodity must also include

  1. ) Location of the property treated by county, section, township, range, base, and meridian.
  2. ) Hour the treatment was completed
  3. ) Operator id number.
  4. ) Site id number issued to the operator of the property treated
  5. )Total planted acreage or units at the site
  6. )Name of the person who made and supervise the pesticide application

Property operator and pest control business must retain these for two years and have readily available to the CAC and DPR.

Submit a use report to the CAC whenever a pest control business applies pesticides for production Ag. Must be done within seven days of application. A copy must also be sent to the property operator who must retain a copy. Must be on a DPR format.

Monthly Summary Pesticide Use Reports

All pest control businesses for Ag. commodities must report a monthly summary of pesticide use to the CAC. Must be hand delivered or mailed by the tenth day of the following month. Report must be made on DPR’s “Monthly Summary Pesticide Use Report form”. Includes

  1. )Name and address of the person, business, or organization who applied the pesticides
  2. )County where the pest control was performed
  3. )Month and year of the pesticide use
  4. )Crop, commodity, or site treated, except when using a designated use code.

  6. )Number of applications made with each pesticide and the total number of applications made during the month.

A licensed pest control business must submit a negative Pesticide Use Report during any month where there is no pest control work performed and submitted to the CAC.

Partial Continuing Education

A

If you are a first time adviser or applicator with a license or certificate that you have held for less than 12 months, then no continuing education is necessary for renewal-if you have held from 12-20 month, only half the continuing education hours are necessary-if held for 21-24 months all the hours are required.
