Restricted Materials
U.S. EPA has designated these as restricted use pesticides.
DPR has designated additional pesticides with certain active ingredients as California restricted materials
The possession or use of restricted materials is regulated closely and allowed under a “restricted materials permit” issued by the County Agriculture Commissioner.
Pesticides with some active ingredients that are potentially more hazardous than others even when they are used according to the registered label.
Federal Restricted Use Pesticides

US EPA categorizes pesticides to be so because of their:
- )Acute dermal (skin) or inhalation (lung) toxicity presents hazards to applicators or others.
- ) Use by people who have not demonstrated a level of competence in the safe handling of pesticides could lead to unreasonable harm to people and the environment.
California Restricted Materials
Use of these restricted pesticides are limited to situations when
1. )Its reasonably certain that no injury shall result.
2. )There is no non-restricted material or procedures that are equally effective and practical.
California DPR categorizes pesticides to be so because of danger it poses to
- ) Public health
- ) Handlers and nearby employees
- )Domestic animal, including honeybees.
- )Nearby crops from drift.
- )Wildlife including persistent residues in the soil.
- )Environment, waterways, air, etc.
- )Subsequent crop from soil residues.
Supervision Standards for Certified Applicators
(Q2.2)
Federal and California restricted materials, shall be used only by, or under the supervision of, a certified commercial or private applicator, unless the label specifies otherwise.
The applicator must be aware of the conditions at the site of application, and be available to direct or control the manner in which applications are made.
Some labels require the certified applicator to be “physically present” (within line of sight) when non-certified handlers are mixing, loading, or apply these pesticides; and when they repair or clean the application equipment.
- )Observe that workers follow label directions appropriately.
- )Intervene if workers fails to follow safe and effective procedures
- ) Provide guidance if label is unclear
- )Respond in the case of an emergency or unusual situation arises.
Restricted Material Use Permit
QAL or supervisee’s must have a valid restricted material use permit before they can purchase, or contain restricted materials. Restricted Material Use Permit may impose additional specific limitations:
*Note: Permit is not required for using or possessing a federal restricted use pesticide that is not listed as a California restricted material; however must be a QAL.
- )Application in specific areas
- )Under certain conditions relating to safety
- )Regarding specified quantities or concentrations
- )Regarding mixtures
- ) In compliance with industrial safety orders from the Dept. of Industrial Relation and any order from DPR, or the CAC.
- ) Agreement to comply from property operator (Notice of Application)
Local conditions that must be considered by CAC or DPR before issuing restricted material use permit:
1.) Location of schools, homes, hospitals, recreational areas, or livestock enclosures.
2.)Problem to nearby crops
3.) The possibility of resurgence of primary pests or secondary pests.
4.) Weather conditions
5.)Timing of application with regard to bee activity.
6.)Pesticide storage facilities (locked away except when someone is in physical control
and disposal of used containers.
Pest control businesses engaged in pest control for hire and individuals engaged in pest control must have a copy of the:

- )Restricted materials use permit.
- ) Written pest control recommendation from a licensed pest control adviser (PCA)
Or grower’s work order covering each agricultural use application.
Alternative and Mitigation Measures
PCA’s and growers must make pest control decisions with the aim of causing the least adverse impact on the environment.
Must consider and adopt if feasible any reasonable effective and practical mitigation measures or alternatives that would substantially decrease any significant harmful effects on the environment.
Non-Agricultural Restricted Materials Use Permit

Includes:
- ) Name and address of the applicant.
- )Restricted material to be used.
- )Pests to be controlled
- )Method of application
- )Criteria for determining need for the pesticide application.
Agricultural Restricted Material Use Permit
(Q2.5)
Restricted material permits for ag use, must have the name of the applicator printed on the permit. An agricultural restricted material use permit must be site and time specific.
- The submitted restricted material permit application and Notice of Intent process authorizes the CAC to determine whether or not to deny the permit depending on hazards.
Issued to the:
- )Operator of property to be treated (responsible for compliance with permit conditions regardless of who signs the permit).
- )Property operator’s authorized representative.
- ) Licensed Agricultural Pest Control Adviser authorized by the property operator.
Also includes,
- 4.) Name and address of the applicant.
- 5.) Location of each property to be treated.
- 6.) Identification and location of all known areas that could be adversely impacted by the use of the pesticides. Including hospitals, schools, residential, public outdoor areas.
- 7.) Identification of each commodity crop
- 8.)Anticipated pest problems for each crop pest/s/
- 9.)Proposed list of the restricted material necessary to control each pest on each commodity, crop, or site.
- 10.)Approximate dates or crop stages of the intended pesticide application.
- 11.) Expected method of application including dilution, volume/acre or other unit, and dosage.
- 12.) Name of pest control business if any, that will be responsible for using or possessing the restricted material; including the name, business address, and the certificate or license number and expiration date of the the QAL.
Notice of Intent:

If approved and issued, a restricted material use permit does not specify the date and time.Therefore the property operator must ensure that a “Notice of Intent” to the CAC is presented at least 24hrs. before beginning the application.
Exception if CAC determines that
- ) Because of the nature of the commodity or pest, spraying may commence sooner.
- ) Evaluation of the intended application does not require 24 hours notice.
If not already listed in the “restricted materials permit”, notice of intent must include:
- )Restricted materials permit #
- ) Name and address of the permittee and the applicator.
- )Location of areas to be treated and the name of the farm operator.
- ) Crop or commodity, for if neither, then the site to be treated.
- )Approximate acres or other units to be treated.
6) .Method of application and the restricted materials to be used - ) Dilution, the volume/acre or other unit (dosage).
- )Pest or pests to be controlled
- ) Date of the intended application to commence.
- ) Locations and identity of areas that have changed since the permit was issued that may be adversely impacted.
Restricted Material Use Permit Duration:
Usually valid for one year, or a growing season, unless revoked or suspended.
CAC or DPR may issue permits for perennial agricultural plantings, non-production sites, or that are even valid for up to three years.
After the permit expires, the permittee may retain possession of the restricted material for the duration that the permit allows, provided the pesticide is not held for sale, and is stored properly.

DPR provides additional pesticide information such as groups of pesticides, first aid, respiratory protection, storage, and disposal, through leaflets, for sites with (“A”) and without ag (“N”) use.
Generalized Effects:
If at anytime pesticide residues, symptoms, or health hazards appear, generally DPR or CAC make a field inspection.
If they determine substantial loss, damage, or injury results from continued application of a specific pesticide within an area, then the CAC may cancel all future permits within that area.
Use Requirements:
Apply to everyone who receives a restricted material permit and may include:
*Employers are required to supply their employees with all PPE and ensure that employees wear the required equipment.
