What do we mean by children and young people
- In England, Wales and N Ireland= under 18
- In Scotland= under 16
Difference in classification between children and young people in UK vs Scotland
- Scotland= concerns over capacity, considered an adult without capacity
- UK= considered a child without capacity
Who makes the decisions with children who lack capacity
- Parents, but are constrained by best interests
- If not, their wishes can be overriden
What should be considered as well as clinical best interests
- View of child/young person
- View of parents/those close to the child/cultural or religious beliefs of child and parents
- Views of other healthcare professionals involved in providing care
- If there is a choice. choose the one that will least restrict the child/young person’s future options
Why is consent more easily accepted than refusal
- Lock and Key analogy
- Only 1 key needed to unlock consent (3 keys potentially exist)

Anyone under 16 cannot be a living donor
