What is a bribe ?
A bribe can be the giving, receiving, offering or promising of an advantage such as a payment, gift or a service for an action which is illegal or a breach of trust

What are the penalties for Bribery ?
Policed by the Serious Fraud Office
Maximum penalty of 10 years imprisonment
and / or
an unlimited fine for both companies and individuals.

LSH Gift giving/receiving policy
Gifts must be:
1. For establishing and maintaining relationships
2. Comply with local law
3. Given and received in the company name
4. Does not include cash
5. Is reasonable and appropriate
6. Received openly and not in secret
What is a non-disclosure agreement ?
An NDA is a legally binding contract preventing the disclosure of confidential information to third parties.
What is the difference between conflict avoidance and conflict management
Conflict avoidance is when you do not accept an instruction.
Conflict management is when an instruction is accepted and steps are agreed and put in place to manage the conflict
What is a conflict of interest
Arises when a member or firms independence and impartiality is threatened due to the conflict between two clients:
- Any Financial interest
- Any Personal interest
- Commercial relationships
- Acting on both sides of a traction
RICS Global Professional Standard 2017: Conflicts of Interest
Must not advise or represent where doing so involves a conflict of interest other than when informed consent has been received.
Informed consent may only be sought where the RICS member or firm is satisfied that the transaction is of interest to all parties and is not prohibited by law
What are the 3 types of conflict of interest ?
- A ‘party conflict’ - relating to work on the same instruction for two different parties
- An ‘own interest conflict’ - relating to a personal conflict
- A ‘confidential information conflict’ - relating to work between parties that is confidential
