- In what year did the Safety Health and Welfare at Work act come in to practice?

- What is a regulation?
a rule or directive made and maintained by an authority eg S.I No 36 of 2016.
A strict law that must be observed by everyone covered in it
- What is a code of Practice?
Gives practicsl guidelins on how to comply with some aspect of the law.
- Give 2 Examples of codes of practice in Agriculture:
Safe equipment and machinery
A safe way in and out of the farmyard including other places of work including farm buildings.
Adequate toilet and washing facilities.
- List one Power the HSA inspector has in regards to a farm inspection?
Enter, inspect, examine and search any place of work without notice and make any enquiries necessary.
Require anybody to provide relevant information.

- What is an improvement notice?
An improvement notice is issued where a hazard or a number of hazards have been identified but are not an immediate risk of serious injury. Tells the farmer what improvements are required and a date for completing them.
- When must the HSA be notified of an accident? (List one example)
Work related accident causing death.
An accident preventing an employee or self employed person from working more than 3 days.
Work accidents causing death or serious injury to person not at work.

A safe place of work.
Safe plant and equipment.
Suitable protective equipment.

- What is Cross Compliance?
A set of requirements the department of agriculture has in place so that farmers comply with current range of schemes in place. Penalties for breaching.

Good agriculture and environmental condition.

Statutory Management Requirements.

1 Environment, limate Change and Good agricultural Condition of land:
Protection of Water against pollution caused by Nitrates - aim to reduction pollution of waters by nitrates and phosphates from agricultural land.
Conservation of Wild Birds.

Area 2 Public Plant & Animal Health
Food and Feed hygience
Cattle identification and registration/ Pig identification.sheep

aimed at improving water quality throughout EU.

What is a prohibition notice?
Issued when there is immediate risk of serious injury. IT orders that the activity causing the safety risk must be stopped with immediate effect.
What are the penalties for non-compliance?
Fined or imprisonment. maximu fine is 3000 euro or 6 months in jail. Serious offences such as non compliance with the terms of a prohibition notice, conviction on indictment can lad to a fine of up to 3 million and/or 2 year prison sentence.
Example of cross compliance sanctions?
Negligence penalty is 3% of aid for year in year in question. Repeated non compliance may be up tp 15% of aid for the year.
Intentional non compliance is 20% depending on severity of non compliance.
Details of how Farers should respect GAEC?
- stablishment of buffer strips along water courses.
- Where use of water irrigation is subject to authorisation, compliance with authorisation procedure,
PRotection of ground water against pollution. - Mimimum soil cover.
- Mimimum land management reflecting site specific conditions to limit erosion.
