What is alternative dispute resolution
submitting a dispute to a trained, un-involved third party for assistance with resolution
What is an appeal?
A request for a review of a case to a higher authority (if permitted by gov. docs or statute)
What are Architectural Guidelines
A rule that applies to the appearance of an owners lot or the exterior of his or her unity or improvements
What is a cease and desist letter?
Notice of a violation, action required to rectify, time frame in which said corrective action should occur, and the penalty (sanction) that will be imposed after hearing if alleged violation is not rectified in time frame given
What is a decision?
Made after a panel determines facts, rule violated, penalty imposed - all used to issue a decision
What is a default hearing?
Hearing held in absence of alleged violator - they have failed to appear
What is due process procedure?
Formal process designed to protect the rights of all parties involved
What is an eviction?
Physical removing of a resident from their property; involves courts
What is a hearing?
Fact finding session, inquiry into allegations and investigation into said violations
What is a hearing notice?
Written notice to alleged violator that a hearing will be held to consider this alleged violation
What is hierarchy of authority?
Rules and architectural guidelines may not contradict or conflict with the legal sources that take precedence of them
What is a resolution?
Motion that follows a set format to formal adoption
What is a rule?
A specific statement of require behavior whose violation caries penalty (i.e. sanctions)
What is self-help?
When a CA takes actions to correct a violation independently.
