Due
Process clause
A clause inv the 14th Ammendment that stops the government from denying citizens their life, liberty, and property Without legal safeguards
Selective incorporation
The process which The supreme court affirms almost all the protections within the bill of rights and apply them to state governments
Establishment clause
Part of the first amendment, Stopping the government from forcing you to be in a religion.
Free exercise clause
Part of the first amendment and allows people to express their religious beliefs.
Freedom of expression
The first amendment allows you to speak, Publish, and protest
Clear and present danger test
If the speech or words of another person starts to harm others, it is not protected by the first ammendment anymore
Prior restraint
The public suspicion of a weapon that could endanger national security
Simbolic speech
A form of speech that is protected by the First Amendment, which includes the form of images, signs and other symbols
Libel
A written statement that is fake. And destroys someone’s reputation.
Slander
A verbal expression that is dishonest and destroys a person’s reputation
Obscenity and pornography
Words, pictures, or videos that show sexual activity that is
Offensive and has no artistic merit
Ex post facto laws
Still be able to be arrested for something that used to not be illegal
Bill of attainer
An individual cannot be punished without trial
Wit of Habeas corpus
A document that is set out for your rest for a certain reason
Procedural due process
A judicial standard that is shown fairness to all individuals equally
Warrant
A document signed by a judge authoritizing a search
Probable cause
A reasonable belief that somebody has committed crime with the proof of evidence
Exclusionary role
Any evidence obtained with auto warrant is inadmissible in court
Grand jury
A group of citizens that collectively decide If a person should be accused of a crime and be punished
Double jeopardy
Stop a court from charging a person with the same crime twice
Miranda Rights
The right to remain silent and not answering anything about an attorney present
Bail
A way for a person to be freed through a certain amount of money paid
