Hostile work environment occurs when there is discriminatory conduct or behavior in the workplace that is unwelcome and offensive to an employee or group or employees.

What 4 criteria violate the Hostile Work Act

A
  • behavior or action must des criminals against a protected class, such as age, religion, disability, or race.
  • it ,use be persuasive, lasting over time, and not limited to an off-color remark that an employee found annoying. The problem becomes significant and persuasive if it is all around an employee, continuous over time, and is not investigated and addressed effectively enough by the organization to make the behavior stop
  • behavior, actions, or communication must be severe and must seriously disrupt the employees work or interferes with an employees career progress
  • employer knew about the actions and/or behavior and did not sufficiently intervene. Employer may be liable for creation of a hostile work environment.
