The Racketeer Influence and Corrupt Organization Act (RICO)

A

To successfully prosecute a person under this statute the government must prove that first, an organized criminal enterprise existed; second, that the enterprise affected interstate commerce; third, the defendant was associated with or employed by the enterprise; forth, the defendant engaged in a pattern of racketeering activity; and fifth, that the defendant conducted or participated in at least two acts of racketeering activity within ten years of each other.

Transfer Evidence at Hit and Run

A

Broken or damaged automobile parts, paint, soil, hairs, fibers, bloodstains, and tire marks all lend themselves to the identification of the type and make of vehicle in the first phase of searching for the vehicle, as well as to later comparison analysis when the suspect vehicle is located. When a suspected vehicle is located, it should be impounded for an immediate search for evidence. All exterior parts of the vehicle should be carefully examined. Special attention should be given to all protruding parts where hairs or fibers might have been caught. All damaged parts should be noted and inspected for traces of blood or signs of contact with other objects. No foreign material should be discarded from consideration until its source is definitely determined. Evidence of recent damages, repairs, new paint, or wash jobs should be carefully noted.
