What basic ideas does the 5th amendment cover
- Before someone can be charged of a serious crime a grand Jury accuse, the individual of the crime.
- You do not have to testify against yourself.
- You can not go to trial over one crime twice
- no person can be denied life, liberty, or property without due process of law.
- The 5th Amendment limits eminent Domain, that is, the government cannot take private property without giving the owner fair payment for it.
According to Miranda v. Arizona, upon arrest police must inform suspects of their rights by informing them:
-They have the right to remain silent. Anything they say can be used against them in court. They have the right to have an attorney present. If they cannot afford an attorney, one will be provided for them.
