4 details for BLOOD samples
- Samples can only be taken under specific conditions
- Results are not available immediately
- Sample collection is more invasive
- Collection requires advanced training
4 details for BREATH samples
- The preferred and accepted method of testing for alcohol
- It is readily adaptable and suitable for field use
- Results are immediate
- Sample taking is minimally invasive
ETHYL Alcohol (type of depressant)
CENTRAL NERVOUS SYSTEM DEPRESSANT
Circulatory System (Things that won’t work to affect intoxication)
- Consuming food will not prevent intoxication
- Neither will consuming energy drinks or caffeine
Metabolizing alcohol (Where and how is it excreted)
- Primarily metabolized by the liver
- Small amounts are excreted through urine and sweat
Elimination (What are the known ways to increase the rate of elimination)
- There is no known way to increase the rate of elimination of alcohol from the body
Drug Impaired Driving - If there is no alcohol involved or …. seek to obtain a blood sample
impairment is inconsistent with alcohol level
Mandatory Booking (what must you do?)
- Confirm the arrested subject has a qualifying prior offense within 10 years (RCW 46.61.5055)
Minor DUI RCW 46.61.503 (BAC concentration, and how close in terms of time in regard to last physical control of the vehicle?)
- Range is at least 0.020 but less than 0.080; and or THC concentration above 0.00 but less than specified in RCW 46.61.502 (5ng)
- Within two hours of operating or being in physical control of a motor vehicle
Evidential Test RCW 46.61.506 (units of measurement, what may the subject request?)
- Breath is measured in g/210 L
- Blood measured in g/100ml
- Suspect may request additional tests
Instrument Error and Refusal (What can or cannot the subject request when using a defective instrument? When an error occurs how much data is kept and is any documentation created?)
- A sample blown into a defective instrument does not relieve the subject of the requirement to five a full test at another instrument. (Subject is required to provide two valid samples on the same instrument)
- If an error occurs, the instrument will record all data up until the point an error occurs (no document will automatically be generated)
Refusals (What determines if a test is a refusal or good test effort?)
- The officer determines if a good faith attempt to provide a sample was made or if it is a refusal
Implied Consent Warning (What can/cannot an officer do when reading this to the subject?)
