Hurt or injury calculated to interfere with the health or comfort of the victim.
What should the ABH not be?
It should not be so trivial as to be wholly insignificant
What can ABH include?
Psychiatric injury, cutting of hair
R v Chan-fook
Interrogated and fell out of a window. Feelings of fear and panic are emotions rather than injury
R v Roberts
Defendant doesn’t have to foresee actions of V, only when V’s actions were so daft that chain in causation breaks
Mens rea
Intention or reckless as to the assault or battery. No additional mens rea for harm caused
