Taking of a person into custody and is the military equivalent of the word “arrest”

Restraint imposed by apprehension

Physical Restraint
Reasonable belief info given is believable and has factual basis.
Probable cause to apprehend
To believe an offense has/being committed by identified person.
Reasonable Grounds
Gives authorization to apprehend persons subject to UCMJ.

Lists who is authorized to make apprehensions
Rule 302b1
On-Base Authority to Apprehend
Have authority to apprehend any subject to UCMJ if probably cause exists.
Civilians can be detained.
Off-Base Authority to Apprehend
May apprehend military members off base, but must be positively identified.
Civilians can’t be detained.
Outside U.S.
Same as on and off base in the U.S.
Based on probable cause
Apprehensions
Sources of probable cause:
(1) Personal Observation
(2) Report by reliable person
(3) Report of complaint or having a positive ID from complainant.
(4) The result of investigation
(5) The result of lawful order given by competent authority.
Things to remember when making contact with suspect:
- Do not apprehend alone.
- Remain alert.
- Scan suspect for weapons
- Maintain reactionary gap
- Be polite, courteous, but firm
Things to evaluate suspect
- Attitude
- Physical condition
- Check for injuries
Course of action when apprehending
- Advise suspect they are being apprehended
- Handcuff suspects
- If weapons involved, immediately handcuff and search suspect
- Remove suspects from area.
