What does JCT Stand for ?
Joint Contracts Tribunal
What is an Employers Agent ?
An agent acting on behalf of the client as the contract administrator for design and build contracts.
What is difference between the Employers Agent v Contract Administrator ?
Same role but administrator different contracts.
What is a letter of intent ?
Is a document that records and outlines in broad terms an agreement between parties to enter into a contractual relationship.
What are the three types of Letter of Intent ?
- Comfort letter - a letter expressing an intention to form a contract.
- Instructions to Proceed with consent to spend - this letter will instruct to proceed and consent to spend to a capped value.
- Letters recognising the existence of a building contract - also know as a letter of acceptance to execute the contract itself.
What is an Extension of Time?
A contract mechanism to extend the contract period, for a delay which is not the contractors fault.
What is a Change Control Process ?
A change control process is a process to ensure changes to a project are
- recorded,
- evaluated,
- authorised
- managed.
What is a pre-construction services agreement ?
This enables clients to Employ Contractors before the main contract has been awarded.
Typically part of a two stage tender process:
1st stage - manage the design
2nd stage - construction
What is a non-completion notice ?
A notice confirming non completion. Must be issued once contract completion date has been missed. Gives client the right to claim LAD’s.
What is Novation?
The process by which contractual rights and obligations are transferred from one party to another.
What happens post Novation?
Original contract is rescinded and new contract is created by different parties .
What is Practical Completion?
The point when a Building is Complete save for minor defects. The client could also take safe possession or occupation.
What is a Certificate of Making Good?
Issued to certify the end of the defect period and confirmation all defects have been rectified.
What is a Forward Funding Agreement ?
These are arranged by someone who is financing the project.
Its the core document that governs the relationship between the borrower and developer.
What’s a Business Case?
A business case captures the reasoning for initiating a project including aims and objectives.
What’s a Project Brief?
The final stage in the process of defining the client’s requirements for a project.

Used where the Employers Requirements are not well developed to calculate a price.

Usually 10% of the contract value to over come contractor non performance.
What is a cashflow ?
It’s the net cash in and cash out of a company.
What is a cost report ?
Used to inform the client about a projects predicted or actual costs.
