What does JCT Stand for ?
Joint Contracts Tribunal
What is an Employers Agent ?
An agent acting on behalf of the client as the contract administrator for design and build contracts.
What is difference between the Employers Agent v Contract Administrator ?
Same role but administrator different contracts.
What is a letter of intent ?
Is a document that records and outlines in broad terms an agreement between parties to enter into a contractual relationship.
What are the three types of Letter of Intent ?
- Comfort letter - a letter expressing an intention to form a contract.
- Instructions to Proceed with consent to spend - this letter will instruct to proceed and consent to spend to a capped value.
- Letters recognising the existence of a building contract - also know as a letter of acceptance to execute the contract itself.
What is an Extension of Time?
A contract mechanism to extend the contract period, for a delay which is not the contractors fault.
What is a Change Control Process ?
A change control process is a process to ensure changes to a project are
- recorded,
- evaluated,
- authorised
- managed.
What is a pre-construction services agreement ?
This enables clients to Employ Contractors before the main contract has been awarded.
Typically part of a two stage tender process:
1st stage - manage the design
2nd stage - construction
What is a non-completion notice ?
A notice confirming non completion. Must be issued once contract completion date has been missed. Gives client the right to claim LAD’s.
What is Novation?
The process by which contractual rights and obligations are transferred from one party to another.
What happens post Novation?
Original contract is rescinded and new contract is created by different parties .
What is Practical Completion?
The point when a Building is Complete save for minor defects. The client could also take safe possession or occupation.
What is a Certificate of Making Good?
Issued to certify the end of the defect period and confirmation all defects have been rectified.
What is a Forward Funding Agreement ?
These are arranged by someone who is financing the project.
Its the core document that governs the relationship between the borrower and developer.
What’s a Business Case?
A business case captures the reasoning for initiating a project including aims and objectives.
What’s a Project Brief?
The final stage in the process of defining the client’s requirements for a project.
What is Steering Committee?
An advisory group that help project teams set direction, scope, goals, budget and timelines.
What is a Gateway System ?
Decision points to help control the brief and direction of a project.
What’s a Design Brief?
The design brief is the key document upon which the design parameters will be based.
What is the Maslow Hierarchy of Needs ?
It’s a motivational technique with five different levels of human needs:

- Love / belonging
- Esteem
- Self-actualisation

What’s a Communication Plan?

Came into force on 1st April 2023.
Creates a universal change in responsibility and culture within the building industry.
Has new duties for management of fire and building safety.
What is a Programme ?
Programmes describe the sequence in which tasks must be carried out so that a project can be completed on time.
What is a critical path?
Its the longest sequence of tasks that must be completed to execute a project.
What is an Acceleration Agreement?
When the client wants to accelerate the works (bring forward the completion date).
What are the Building Regulations 2010?
Statutory Regulations for the minimum building standards that are to be achieved.
What are Secant Piles ?
These are interlocked piles.
What is Design and Build ?
Main contractor is appointed to design and build the project via a single point of responsibility.
What is Design and Build single stage ?
Used when all information is available to allow a single price to be provided (single tender).
What is Design and Build Two Stage ?
Used where the Employers Requirements are not well developed to calculate a price.
What is Traditional Procurement ?
Includes separating design from construction. Usually on a lump sum basis.
What is Value Engineering?
Cost cutting. Reduce costs.
What is a Framework Tender ?
This allows the client to invite tenders for goods and services on a call off basis.
What is Procurement Selection ?
The selected route that should follow a strategy which fits the long term objectives of the business plan.

What is a defined provisional sum?
It’s defined sufficiently to allow the contractor to price, programme and plan.
What is a Bond?
A means of protection from a contractors non performance.
What’s a Performance Bond?
Its a financial guarantee to one party in a contract against the failure of the other party to meet its obligations.
Usually 10% of the contract value to over come contractor non performance.
What is a cashflow ?
It’s the net cash in and cash out of a company.
What is a cost report ?
Used to inform the client about a projects predicted or actual costs.
Can you name some insurance types ?
- Contractors all risk
- Employers Liability Insurance
- Professional Indemnity Insurance
- Public Liability Insurance
What is Early Access ?
Client can use areas before PC is achieved and all risk remains with contractor. contractor retains site in their possession.
What is a Change Control Process ?
Is a defined process to ensure project changes are:

- Evaluated
- Authorised
- Managed
What is a Sectional Completion ?
Is pre-planned and usually defined to allow different completion dates for different sections.
What is a Pay-less Notice?
Signifies that the previously agreed payment is not going to be paid in part or in whole by the Employer.
What is Common Law?
Law declared by Judges and derived from custom and precedence set in courts.
What is the Equality Act 2010?
Legislation that legally protects people from discrimination in the work place and in wider society.
What are the Employers Rights Act 2008 ?
It reforms the existing law covering industrial relations and Employment protection.
What is conflict of interest ?
A situation in which the duty of an RICS member conflicts with a duty owed to another.
What is a Business Case?
The information necessary to enable approval, authorisation and allow policy making bodies to asses a project proposal to reach a decision.

Sets out exactly what services a consultant will perform on a project.
