What are some requirements of notes?
They should be close to or at the time of activity
Recorded accurately, objectively, completely, concisely, and clearly

Avoid hearsay, opinions, conclusions, and inferences
What does it mean that notes are “discoverable”?
Jenks Act (18 USC 3500) = Defense counsel to be provided witness’ statements (which can include notes)
Rule 16a, Federal Rules of Criminal Procedure = “Discovery” rule allows defense attorney to obtain certain investigative documentation, including notes before trial
Therefore law enforcement notes should be maintained until all court actions, including appeals, have been completed
