Air Service
Any service provided by operator of aircraft for purpose of monetary reward
Air Operator Certificate
Required to operate an air service
AOC Exceptions
- Farmer owns a crop duster and disperses product within 25 NM of farm
- flight training unit AOC holder operates a day VFR sightseeing flight
AOC Eligibility
Must be a Canadian citizen, hold an AOC from a foreign state you are a citizen or resident of, or hold an AOC from US or Mexico provided it is a specialty air service operating under NAFTA rules and you are a citizen or resident
AOC Commercial Air Service Aircraft Requirements
- If aircraft is Canadian, must be type certified and flight authority has been issued
- If aircraft is registered in foreign state, the minister must authorize its operation
Commercial Air Service - Aerial Work
- Carriage of persons other than flight crew members (photographers, fire spotters)
- Helicopters carrying class B,C or D external loads
- Towing of objects
- Dispersal of Products
Commercial Air Service - Air Taxi
- Air transport service
- All single-engine aircraft
- Multi-engine aircraft with MCTOW of 19,000 lbs or less AND a passenger seating configuration of 9 or less
- Any other aircraft authorized by the minister
Commercial Air Service - Commuter
- Air transport service
- Multi-engine aircraft with MCTOW of 19,000 lbs or less AND a passenger seating configuration of 10-19
- Turbo-jet aircraft with maximum zero fuel weight of 50,000 lbs or less AND for which a Canadian type certificate has been issued authorizing the transport of not more than 19 passengers
- Any other aircraft authorized by the minister
Commercial Air Service - Airline
- Air transport service
- aircraft with MCTOW of more than19,000 lbs OR for which a canadian type certificate has been issued authorizing the transport of 20 or more passengers
- A helicopter that has a passenger seating configuration of more than 20 people
- Any other aircraft authorized by the minister
Flight / Duty Time Monitoring System
- Every air operator must create a system that monitors crew’s flight time, duty time, and rest time
- This system must be described in the company’s operations manual
- Still crew member’s responsibility to inform air operator if assigned flight exceeds any limitations
Flight Time Definition
- Starts from the point the aircraft starts moving under its own power for the purpose of taking off
- Ends at the point it comes to rest at the end of the flight
Flight Time Limitations
- Can’t assign and can’t accept the following limitations
- 1000 hours in any 365 consecutive days
- 300 hours in any 90 consecutive days
- 112 hours in any 28 consecutive days (100 hours if on call)
- For aerial work and air taxi, 60 hours in any 7 consecutive days also applies
Flight Duty Time Definition
- starts when a crew member reports for a flight
- ends when the engine stops on the final flight
Minimum Rest Period Definition
- crew member is relieved of all duties
- is not interrupted by the air operator
- provided with an opportunity of no less than 8 consecutive hours of sleep in suitable accommodation
- time to travel to and from that accommodation and time for personal hygiene and meals
Flight Duty Time Limitations
- 14 hours in any 24 consecutive hours
- After a duty day, a crew member must receive a minimum rest period
- Must use rest period provided to obtain necessary rest
- Must be adequately rested prior to reporting for flight duty
Unforseen Operational Circumstance Definition
Event that is beyond the control of the air operator
Flight Duty Time Extensions
- Maximum Flight Duty Time may be extended due to Unforeseen Operational Circumstance if:
- Pilot in Command consults with other crew members and considers it safe to do so
- The extension is not more than 3 hours
- Crew members receive additional rest time equal to the extension
- Operator is notified, and in turn notifies Transport Canada
Aerial Work Oeprations
- Use of an aircraft for work not involving flight training or carriage of passengers for purpose of transportation
- Surveying, Crop dusting, Parachute Jumping
Aerial Work Operations - Operating Instructions
- Air operator must ensure that all personnel are properly instructed about their duties and about their relationship of their duties to the operation as a whole
- Operations Personnel shall follow procedures specified in air operator’s company operations manual
Aerial Work Operations - Flight Authorization
No person shall commence a flight unless it has been authorized in accordance with the air operator’s operations manual
Aerial Work Operations - Operational Flight Plan
- No person shall commence a flight unless a flight plan has been filed in accordance with the air operator’s operations manual
- Similar to ICAO flight plan, slightly extra details in certain areas
Aerial Work Operations - Carriage of Persons
Can not carry people other than flight crew unless they are:
- essential during the flight
- air operator certified to do parachute descents and they are a parachutist
- air operator authorized to carry a person
Aerial Work Operations - VFR minimum flight visibility
When in Day VFR in uncontrolled airspace less than 1000 AGL, someone may operate in less than 2 miles visibility if:
- authorized to do so in AOC
- complies with commercial air service standards
Aerial Work Operations - Night VFR OTT and IFR Operations
No air operator shall operate at night in VFR OTT or IFR:
- while towing
- while carrying a helicopter class B,C, or D external load
- while dispersing products
- where the aircraft is single-engine
- UNLESS authorized by the minister and in compliance with commercial air service standards
No air operator shall operate at night with people other than flight crew on board unless:
- pilot in command has instrument rating
- or the air operator is authorized to permit parachute descents in night VFR and other people on board are parachutists and flight takes place within 10 NM of departure aerodrome
- air operator is authorized in AOC to carry people other than flight crew or parachutists and is in compliance with commercial air service standards
Aerial Work Operations - Aircraft Operating Over Water
Can’t operate over water further than aircraft can glide unless:
- Authorized in AOC and complies with commercial air service standards
- Only applies to helicopters
