How are judges often represented in the media?
• Old, white, upper-class males
• Out of touch with modern society
• Too soft on crime
Why do some people say judges are out of touch?
• 71% are male
• Over 50% are aged 50+
• Only 5% are from ethnic minorities
• 74% went to Oxbridge

Is there evidence judges are not out of touch?
• Among judges under 40, most are women (51%)
• Warner study (Australia): Most people didn’t feel judges in their cases were out of touch
Is there proof that judges are biased?
•Hard to prove
•Most offenders are young, making it hard to compare age bias
• No clear pattern of general bias
Is there gender bias in the judiciary?
Some say judges show less empathy for female victims
• Leniency toward female offenders
• Example: Judge Pickles’ sentencing
Is there class bias in the judiciary?
Yes, in some cases
Example: Lavinia Woodward (trainee doctor) avoided jail for stabbing her boyfriend because her skills were seen as too valuable
What is the Unduly Lenient Sentences Scheme?
• Allows victims/public to challenge sentences
• Attorney General can ask Court of Appeal to increase a sentence for serious crimes (e.g. rape, murder)
Does the Unduly Lenient Scheme show judges are too soft?
• Very few sentences are changed
• Suggests judges are not too lenient overall
Is there evidence judges are too harsh?
Yes, in some cases
• Example: 2011 Riots – 18-year-old jailed for one day for stealing two Burberry t-shirts
