what is the due process model
assumes innocence before guilt, protects both defendants and victims rights to allows a fair trial, to prevent a wrongful conviction
innocent till proven guilty.
relates to the left realist approach, focusing on a more equal and caring society would eliminate crime
aims to rehabilitate/focus on why someone committed that crime.
what is the crime control model
aims for a quick and efficient disposal of cases, similar to a conveyer belt.
aims to punish and stop criminals committing further crime
focus on protecting rights of the victim not the offender
guilty till proven innocent/ believe everyone is guilty
believe police should have enhanced powers, links to zero tolerance approach found in right realism.
does not address the causes of crime or that crime can be deterred through conviction.
strengths of the due process model
ensures there is a fair trail, allowing them to convict the right offender/ ensures everyone is being treated the same.
limits powers of the police, an individual has a right to defend themselves/ ensures police are held accountable for their actions, ensuring everyone is treated the same
weaknesses of the due process model
slow process, this means it is more expensive/ could have an affect on victim since they are having to go through the process for a long time meaning they are re living what they went through
due process doesnt consider defendents who suffer from mental illness/ King(1981)suggest criminals may need treatment to ensure they don’t re offend/ therefore shows parkers theory lacks creditability
strengths of the crime control model
efficient/ like and assembly line allowing them to get through more cases meaning more criminals are out of society allowing them to protect the public
encourages punishment- this is good because it will deter society from committing similar crimes due to them seeing the harsh punishments offenders go through
weaknesses of the crime control model
police brutality/ police have the powers meaning they can target people and wont be punished for what they have done.
offenders don’t have the right to a fair trial
doesn’t tackle the main reasons as to why someone commits crime which can therefore lead to further crime being committed
